Evolt Charging Maintenance Warranty Terms

APPENDIX C – WARRANTY TERMS FOR MAINTENANCE SERVICES

1.Warranty Period

1.1.Original Warranty Period

The warranty period for Maintenance Services is 90 days from:

a.
Completion of the Services; or
b.
Acceptance of the Services where acceptance is required.

1.2.Re-performed Maintenance Services

Where Maintenance Services are re-performed to remedy a defect, the warranty period for the remedial work will be 30 days, but will not extend beyond 90 days from the start of the original warranty period

2.Warranty Claims

2.1.Notification

Customer must notify EVOLT in writing of any breach of the Services warranty within the applicable warranty period and as soon as reasonably practicable from the moment it discovers the said breach.

2.2.Remedy

EVOLT will remedy any valid warranty claim by re-performing the affected Services within a reasonable time, or any other time agreed between the parties.

2.3.Customer cooperation

Customer will:

(a)
Provide access to the relevant infrastructure;
(b)
Provide operational data and logs; and
(c)
Assist in diagnostics where required.

If EVOLT is able to demonstrate that no warranty breach exists, Customer will reimburse EVOLT for reasonable costs incurred.

3.Warranty Exclusion

The warranty applies for the warranty period only and does not apply for defects caused by:

a.
Misuse, negligence, or improper operation;
b.
Failure to follow EVOLT operating instructions;
c.
Unauthorised modifications or repairs;
d.
Third-party equipment or software;
e.
External factors beyond EVOLT’s reasonable control including network outages, grid failures, or vandalism.

4.Exclusive Remedy

Clauses 1-3 set out EVOLT’s entire liability and Customer’s exclusive remedies for Maintenance Services warranty claims.
